What can be protected as an Trademark?

Depending on the mark and the applicable legal requirements, trademark protection may be considered for:

  • Business and brand names
  • Product or service names
  • Logos and visual identities
  • Combined name-and-logo marks
  • Distinctive packaging or visual elements
  • Other legally recognized forms of marks

The Bahrain Ministry of Industry and Commerce (MOIC) describes a trademark as a sign used to distinguish one establishment’s goods, products or services from those of another. Its guidance also recognizes that sound or smell may, in appropriate circumstances, constitute a mark.

The Trademark Registration Process in Bahrain

1

Initial Consultation

We review the proposed mark, applicant, relevant goods or services, business activities and intended markets.

2

Trademark Search

We conduct a preliminary search for potentially conflicting marks and consider whether the proposed mark appears sufficiently distinctive.

3

Classification Strategy

Goods and services must be placed in the appropriate class or classes under the Nice Classification. The selection should reflect both the business’s current activities and reasonably anticipated use.

4

Application Preparation

The application and supporting documents are prepared and submitted through the relevant Bahrain industrial-property system.

5

Examination

The competent authority examines the application. If an official query, condition, objection or refusal is issued, the applicant may need to respond within the applicable procedure and deadline.

6

Publication

We monitor the progress of the application, respond to any official queries where necessary, and guide you through publication and registration.

7

Registration and Renewal

Subject to completion of the applicable procedures, the mark proceeds to registration. Bahrain’s MOIC states that protection lasts for ten years from the application date and may be renewed for further ten-year periods.

A Bahrain registration should not be assumed to provide protection automatically throughout the GCC. The filing strategy may require separate national applications, use of an available international-registration route, or a combination of approaches.

No. A commercial registration and a trademark serve different purposes. Registering a business or commercial name should not automatically be treated as equivalent to securing trademark protection for that name.
