Legal Protection Against Unfair Dismissal in Construction Projects in Bahrain

Legal Protection Against Unfair Dismissal in Construction Projects in Bahrain

In Bahrain’s construction and contracting sectors, job security is a major concern for workers, especially in high-risk environments where disputes or safety issues may arise.

Unfair dismissal  termination of employment without a valid legal reason or due process is prohibited under Bahraini labour law.

Workers have strong legal protections to ensure that their contracts cannot be ended unlawfully.

This blog explains what constitutes unfair dismissal in construction projects, the legal rights of workers, and the steps to take if you are dismissed unfairly.

What is Considered Unfair Dismissal?

An unfair dismissal occurs when a worker is terminated:

  • Without a valid legal reason.
  • Without following the proper disciplinary process.
  • In retaliation for filing a safety complaint or labour grievance.
  • While on legitimate sick leave or during recovery from a workplace injury.
  • Because of discrimination based on nationality, religion, or other protected factors.

Legal Grounds for Termination in Construction

Employers may terminate a worker’s contract only if:

  • There is a serious breach of contract (e.g., repeated safety violations).
  • The worker is unable to perform the job despite reasonable training.
  • The project ends and the contract was project-specific (with proper notice).

Even then, the employer must give notice as required in the contract and the law.

Worker’s Legal Protections

  • Workers cannot be dismissed for refusing unsafe work.
  • Filing a complaint with the Ministry of Labour is a protected right.
  • Pregnant workers or those on maternity leave have special protection from dismissal.
  • Workers injured on the job cannot be terminated while receiving medical treatment and benefits.

Steps to Take If You Are Unfairly Dismissed

  1. Request Written Reasons
    • Ask your employer to provide the reason for dismissal in writing.
  2. Gather Evidence
    • Keep copies of your contract, payslips, and any communications.
  3. File a Complaint
    • Report the case to the Ministry of Labour for investigation.
  4. Consider Court Action
    • If mediation fails, take the case to the Labour Court for compensation and reinstatement (where applicable).

Example:

A construction worker reported unsafe scaffolding to the site supervisor. Days later, he was dismissed without notice. He filed a complaint with the Ministry of Labour, which ruled the dismissal unlawful. The employer was ordered to pay full compensation for lost wages and damages.

Best Practices for Workers

  • Always keep a signed copy of your contract.
  • Document all workplace disputes in writing.
  • Report unsafe conditions through official channels.
  • Seek legal advice before signing any termination agreement.
