Consumers increasingly rely on advertisements, online product images, specifications and descriptions when deciding what to purchase.

However, where the product received does not match what was advertised, the issue can go beyond customer dissatisfaction and potentially raise questions under Bahrain’s consumer protection laws.

Speaking on consumer rights, lawyer Manal Yusuf of Manal Dhahi Legal Group explained that sellers and service providers are expected to provide clear and accurate information about the products they offer.

When Does Advertising Become Misleading?

Advertising may become problematic where it creates a false impression regarding a product’s quality, origin, characteristics, specifications or other material features.

This can include situations where:

  • product images materially differ from the item supplied;
  • specifications are inaccurate;
  • important limitations are not disclosed;
  • descriptions exaggerate the capabilities or quality of a product; or
  • information provided to consumers is otherwise misleading.

Where consumers rely on such representations when making a purchase, the discrepancy may engage protections available under Bahrain law.

What Should Consumers Do If a Product Does Not Match the Advertisement?

Consumers who receive a product that differs materially from what was advertised should retain evidence relating to the transaction.

This can include:

  • screenshots of the advertisement;
  • product images and descriptions;
  • receipts and invoices;
  • correspondence with the seller;
  • return or refund policies; and
  • photographs of the product actually received.

Keeping these records can help establish what was represented at the time of purchase and how the delivered product differed from those representations.

What Are Sellers Required to Disclose?

Businesses should provide consumers with sufficient information to make an informed purchasing decision.

This includes presenting important product details clearly rather than relying on descriptions or images that could create an inaccurate impression.

According to Yusuf, transparency is particularly important in areas such as product quality, authenticity, specifications and characteristics.

Accurate information helps consumers understand what they are purchasing and reduces the risk of disputes after the transaction.

Consumers should retain evidence of the advertisement, receipt, product description and communications with the seller. Depending on the circumstances, consumer-protection remedies such as return, replacement, exchange or refund may be available.

Misleading advertising can potentially violate Bahrain’s consumer protection framework where false or inaccurate representations are made about a product or service.

Consumers should consider retaining screenshots of advertisements, order confirmations, receipts, invoices, product descriptions and communications with the seller.

A consumer may have grounds to seek a refund, replacement or other remedy where the product materially differs from what was represented. The appropriate remedy will depend on the facts and applicable consumer-protection rules.
